Failure to pay land tax nets Crown land user $3,000 fine

PARRY SOUND — A dispute over who pays the taxes on a land rental agreement with the province will cost the tenant an extra after he lost in court.

The Aylmer man who leases public land on NisbetLake has been fined $3,000 for violating the conditions of his Land Use Permit, the MNR says in a news release.

Daniel Martindale was found guilty at trial for failure to pay taxes, which is a condition of his land use agreement.

The court heard that Martindale has occupied public land since 2001 under the authorization of a Land Use Permit in an “unsurveyed township” south of the FrenchRiver and north of Parry Sound.

A condition of his original Land Use Permit required Martindale to pay annual property taxes to the local taxing authority.

Martindale argued at trial that he felt he was not required to pay the taxes, and that it was the responsibility of Ministry of Natural Resources to pay on his behalf.

Justice of the Peace James Bubba heard the case in the Ontario Court of Justice, Parry Sound, on March 12, 2014.

Martindale was found guilty and was sentenced on April 15.
